Terms of Service

1. Acceptance
By using evotare.com and the eVotaré platform, you agree to these Terms of Service. If you do not agree, do not use the service.
2. The service
eVotaré provides a hosted, multi-tenant elections and voting platform with verifiable, Merkle-certified results.
3. Accounts & eligibility
You are responsible for safeguarding your credentials and for all activity under your account. Accounts are for a single person, and you must be authorized by your organization to use the platform on its behalf.
4. Acceptable use
You agree not to:
- use the service for any unlawful purpose;
- interfere with election integrity or results;
- attempt to deanonymize cast ballots;
- scrape or subject the service to automated abuse; or
- circumvent or probe the platform's security.
5. Organization (tenant) responsibilities
Organizations are responsible for the accuracy of their voter rolls, for obtaining lawful consent before adding voter contact details, and for compliance with their own bylaws and applicable election law.
6. Messaging & email programs
By enrolling, you consent to receive the messages described in our Messaging Terms. Message frequency varies, and message and data rates may apply. Reply STOP to opt out and HELP for help.
7. Intellectual property
The platform and its content are owned by M at B LLC. We grant you a limited, revocable license to use the service as intended.
8. Disclaimers
The service is provided "as is" and "as available." We do not warrant that it will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, M at B LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
10. Indemnification
You and your organization agree to indemnify and hold us harmless from claims arising out of your misuse of the service or violation of these Terms.
11. Termination
We may suspend or terminate accounts that violate these Terms or that threaten the integrity or security of the platform.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
13. Changes
We may update these Terms from time to time. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
